By accessing, browsing, or using the CasaAtacama.com website and by booking a stay at Casa Atacama Resort ("the Hotel"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
2. Reservations and Payment
All reservations made through our website are subject to availability and confirmation. The following payment conditions apply:
- Rates: All prices are quoted in US Dollars (USD) and are subject to applicable local taxes unless stated otherwise.
- Deposit: A valid credit card is required to secure your reservation. Depending on the booked rate, a deposit of 50% or the full amount may be charged at the time of booking.
- Final Payment: The remaining balance of your reservation, along with any incidental charges incurred during your stay, must be settled upon check-out.
3. Cancellation and Refund Policy
We understand that travel plans can change. Our cancellation policy varies depending on the specific room rate and package selected:
- Flexible Rates: Cancellations made up to 14 days prior to the arrival date are fully refundable. Cancellations made within 14 days will incur a charge equivalent to the first night's stay.
- Non-Refundable Rates: Bookings made under discounted or promotional non-refundable rates cannot be modified or cancelled. The total price of the reservation will be charged in case of a no-show or cancellation.
In the event of unforeseen circumstances or force majeure, Casa Atacama Resort reserves the right to modify or cancel reservations, offering a full refund or an alternative date of stay.
4. Check-in and Check-out
Check-in time: From 3:00 PM local time.
Check-out time: By 12:00 PM (noon) local time.
Early check-in and late check-out are subject to availability and may incur additional charges. Guests are required to present a valid government-issued photo ID and the credit card used for booking upon arrival.
5. Guest Conduct and Age Requirements
To ensure a serene and luxurious environment for all our guests, Casa Atacama Resort enforces specific conduct policies:
- Age Requirement: The primary guest making the reservation must be at least 18 years of age.
- Casino Lounge Access: Access to the private casino lounge is strictly restricted to guests aged 18 and older. The Hotel reserves the right to request valid identification for age verification prior to entry.
- Damage to Property: Guests are responsible for any damage caused to the hotel property by themselves or their visitors. The Hotel reserves the right to charge the guest's credit card for the cost of repairs or replacements.
- Smoking Policy: Casa Atacama Resort is a non-smoking property indoors. Smoking is only permitted in designated outdoor areas. A deep cleaning fee will be applied for violations of this policy.
6. Limitation of Liability
While we strive to provide a safe and secure environment, Casa Atacama Resort is not liable for any loss, theft, or damage to guests' personal belongings or vehicles. Guests are encouraged to use the in-room safes provided for valuables. Furthermore, the Hotel shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or services.

Your use of our website and services is also governed by our Privacy Policy. We are committed to protecting your personal data in compliance with relevant international and local data protection regulations.
8. Governing Law and Jurisdiction
These Terms of Service and any disputes arising out of or related to your booking or stay at Casa Atacama Resort shall be governed by and construed in accordance with the laws of the Republic of Chile. Any legal actions must be brought exclusively in the courts of Santiago, Chile.
